A successful procedural defence for the employer

The employment claim had been filed electronically, but neither the pleading nor the relevant filing report bore the advanced electronic signature of the lawyer who submitted it.

Following the objection raised on behalf of the employer, the Court held that the pleading was procedurally non-existent and invalid. It dismissed the employee’s claim in its entirety.
