Asset management and estate planning
Our office prepared a private agreement establishing a trust under which corporate participations are placed under the administration and management of a trustee for the benefit of the settlor and beneficiary.
The agreement provides for the separate management of the trust assets, the duty to follow the beneficiary’s instructions, the rendering of accounts, entitlement to the benefits arising from the assets and liability for mismanagement.
The agreement also regulates the duration and early termination of the trust, replacement of the trustee, any further transfer of its assets and their treatment following the beneficiary’s death.
