Consensual dissolution of property co-ownership
Our office represented one of three co-owners in a pending dispute concerning the dissolution of co-ownership and partition of their jointly owned property.
Through the successful mediation, the parties agreed to pursue a consensual sale of the property by 30 September 2022 for no less than €360,000 and to distribute the price and related expenses in accordance with each party’s one-third co-ownership share.
If a sale could not be achieved on the agreed terms, the settlement provided for a binding auction mechanism that any party could initiate, followed by equal distribution of the net proceeds. The mediation record was filed with the registry of the Athens Multi-Member Court of First Instance so that it would constitute an enforceable title.
